"At Wednesday’s school board meeting in Croydon, a former school board member and current math teacher — the latter detail turns out to be important — stood up to say that he is ‘happy to help pay to educate other people’s children.’

Now, this guy pays at most a few thousand dollars each year in school taxes.  At the same time, the town pays at least fifty thousand dollars each year towards schooling his three kids.

Put a few thousand in, take fifty thousand out.  In what sense is he helping to pay for anything?

To put that a different way, ask yourself:  If you put $3 in the poor box, then reach in and take out $50, in what sense are you helping the poor?

Of course, maybe he means he’ll be happy to keep paying even after he’s paid back what he’s taken from the town.  When would that start?

Well, $50 thousand a year times thirteen years (K-12) is $650 thousand.  If he’s paying $2500 a year in school taxes, he should be able to get around to actually helping in about 250 years.

As Richard Mitchell might say, the really interesting question here is whether this guy understands what he’s saying, or doesn’t understand it. In either case, you can at least be happy that he’s probably not teaching math to your children."

Can't we Just Focus on Reading, Writing and Math?

We can not even get children to read, write or perform math at grade appropriate level, lets get that down first before we start teaching about orgasms. The NEA has some very messed up priorities.

"Schools need to teach about orgasms" says NEA to UN

NEW YORK, March 3 (C-FAM) Graphic sex education for youth is the new battleground at the UN, as evidenced by side events during the past week at the Commission on the Status of Women.

The theme of this year’s CSW is the “access and participation of women and girls to education, training, science and technology.” While delegates are busy negotiating resolutions and outcome documents, non-governmental organizations (NGOs) and UN organizations campaign for the installation of socially radical curriculums in Africa and America alike.
“Oral sex, masturbation, and orgasms need to be taught in education,” Diane Schneider told the audience at a panel on combating homophobia and transphobia. Schneider, representing the National Education Association (NEA), the largest teachers union in the US, advocated for more “inclusive” sex education in US schools, with curricula based on liberal hetero and homosexual expression. She claimed that the idea of sex education remains an oxymoron if it is abstinence-based, or if students are still able to opt-out.

Comprehensive sex education is “the only way to combat heterosexism and gender conformity,” Schneider proclaimed, “and we must make these issues a part of every middle and high-school student’s agenda.” “Gender identity expression and sexual orientation are a spectrum,” she explained, and said that those opposed to homosexuality “are stuck in a binary box that religion and family create.”

A Belgian panelist at the same event explained how necessary it was to have government support when educating about anti-discrimination issues. He claimed that the “positive, pro-LGBT policies in Belgian schools are a direct consequence of liberal and open-minded legislation in Belgium,” and went on to stress the importance of states in providing relevant materials for students and schoolteachers. He also held up Belgium’s “gender in the blender” programs, which are discussion-based programs for Belgian teachers who want to discuss gender and transgender issues in their courses, as a model for other nations who wished to encourage their teachers to address these topics.

The UN system was also advocating for the sexualization of youth at this year’s CSW. A panel sponsored in part by the UN Population Fund (UNFPA) advocated for “comprehensive sex education” not only as a tool to combat “gender oppression,” but also as the key to achieving all of the Millennium Development Goals. The panelists presented the highly controversial UNESCO guidelines on Sex Education, as well as a new IPPF-sponsored curriculum as the gold standard for comprehensive sex education. Both curriculums promote a liberal approach to sex, approve of masturbation, and expose children to graphic content in their youngest years. The panelists also insisted that these programs be implemented in schools in order to reach as many students as possible, and they also recommended they start as soon as possible, given the fact that many girls in developing countries leave school before the age of sixteen.

Although most of the side events during CSW are not sponsored by governments and attract few delegates, the NGOs who produce the events are UN lobbyists – which means that the agendas on display during this year’s CSW will influence UN policy in the near future.

A teacher who advises colleagues on how to avoid affairs with students was caught having sex with a teenager in the back of her car.

Courtney Bowles was found by a police officer naked lying on top of the boy, who was also completely naked, from her school in Colorado.

A partly consumed bottle of vodka was also found in the car with the couple.



Her student lover initially said he was 20 years old - but later admitted he was 16.

Bowles,31,was employed at his school as a teacher's instructional coach. It was her job to trains teachers on how to maintain a professional distance from students.

Unfortunately for the teacher, the evidence of her dalliance with the student was rather overwhelming when a police patrol spotted a lone car parked in a park in the town of Loveland.

When an officer shone his torch into the car he saw they were having sex.

According to an arrest report the officer wrote: 'The female was on top of the male and she quickly jumped off of the male when she saw my flashlight shining into the vehicle.

'I told both subjects that I could see they were naked and they needed to get dressed and talk to me.'

Investigators said the boy initially told the officer he was 20 years old, but when asked for identification he produced a school ID card that showed him to be 16.

The officer also found a bottle of vodka inside the vehicle.

Bowles, a mother of two, was booked into the Larimer County Detention Centre on charges of sexual assault, sex assault of a child by a person in a position of trust and contributing to the delinquency of a minor.

She was released on $50,000 bail but not allowed contact with anyone aged under 18 years of age, including her own children - both girls.

Counsellors were called into the Mountain View High School where she worked to help any children troubled by the arrest.

She faces up to ten years in jail if convicted of all the offences and placed on a sex offenders register for life.

Should schools be giving out tickets?

Schools Giving Tickets, Not Detention Slips, Report Says

DALLAS (CBSDFW.COM) – Court has become a deterrent instead of detention for some North Texas students.

The social and economic group Texas Appleseed collected five years worth of data from 22 districts across the state and found young students, including a six year old in Dallas, who received class C misdemeanor tickets for things like disrupting class, leaving school early and school yard brawls that didn’t include weapons.

“Dallas ISD was one of the districts that had a very large number of elementary school students that were issued class C misdemeanors,” said Deborah Fowler, of Texas Appleseed.

Over the course of five years, more than 1200 elementary students in DISD received a ticket.



O.M. Roberts Elementary parent found Abby Amadore found that alarming. “It’s the (school district’s) job to help us as parents to help them determine what’s right from wrong. I don’t think it’s correct to give them a ticket at six years old,” said Amadore.

In 2006-2007, over 4,000 DISD students received tickets but one parents said depending on the student’s age it may not be a bad way to curtail persistent misbehavior.

“It just depends the age and what the student did,” said DISD parent Claudia Diaz.

Data shows the tickets can cost a family as much as $500.
DISD issued a statement on the report, saying “The district’s number one priority is safety and the learning environment should never be compromised. The vast majority of our students are not disruptive. Those who do receive tickets are hopefully learning that their actions have consequences.”

School to Provide Condoms for 11-Year-Olds

A New England school district has approved a measure that will provide free condoms to elementary school students and direct teachers not to comply with parental wishes to the contrary.

The policy, unanimously approved by the Provincetown School Committee does not include an age limit — meaning children of any age ask for — and receive — free condoms.




The committee also directed school leaders not to honor requests from any parent who might object to their child receiving condoms. In other words mommy and daddy — you don’t have a right to prevent your 7-year-old from getting a contraceptive device.

The policy does stipulate that kids must consult with a nurse or trained counselor before getting their sexual protection – and that upset some of the committee members, according to the Provincetown Banner.

“I can see some kids opting out because of the conversation. I’m not against [the policy]. I’m just trying to put myself in that teenager’s spot,” said committee member Carrie Notaro.

“I don’t like that students can’t be discreet about this,” committee member Shannon Patrick told the newspaper. “They have to go and ask for it. I’d rather them not have the conservation [with counselors] and have the condom than not have the condom.”

School superintendent Beth Singer supported the instruction aspect of the rule – explaining that younger boys and girls might not be experienced in such adult matters.

“We’re talking about younger kids,” she told the newspaper. “They have questions they need answered on how to use them, when to use them.”

Reaction has been mixed on newspaper websites. One reader opposed to t he measure wrote, “A condom distribution policy at the elementary school? Twelve-year-old kids need condoms? When I was 12, I thought a peck on the lips was something.”

Another reader wrote, “Stupidity exists everywhere. Why not just give the kids free needles while we’re at it?”

However, a supporter of the measure praised committee members.

“If the kids really are sexually active that young these days, then they absolutely should have access to condoms. Sure, it’s demoralizing to think of 11 and 12-year-olds starting at that age, but if they are, they’re not going to stop.”

The Slow Awakening

When Jim and I started fighting for education reform and education spending reform in Harvard many people did not like us or trust us but people eventually came around. We know the tax eaters, those living off the taxpayer teat and socialist will never like us and that is okay. In Illinois eventually more people came around to our side, hopefully someday more people will come around to our side in Croydon as well.

Education reform

To the Editor:

I can’t even begin to tell you how much it warmed my heart to read the comments to Tony Casalino’s letter to the editor entitled “Supports tax increase” (May 1).

My husband, Jim, and I fought for education reform and education spending reform for four years before we decided not enough people were on board and Illinois was on a nonstop train to bankruptcy due to its spending problems and pension problems.

Good luck to you all, but you must do more than just respond to letters to the editors in newspapers. You must educate your friends and family, start tax-fighting groups, run for public office and, most importantly, support and vote for people who will be fiscally responsible and fight for true education reform.

Do not vote for any candidate who is funded with teachers union dollars. These are just your own education dollars working against you and your children’s futures.

Those policies have been shown to be not in the best interest of our children. Teachers have gone from being underpaid, to now being grossly overpaid. These costly teachers contracts get approved because parents can't take off work while a teachers strike. It's all out of control."

Black Americans and Liberty

Having recently reached 74 years of age, if one were to ask me what's my greatest disappointment in life, a top contender would surely be the level of misunderstanding, perhaps contempt, that black Americans have for the principles of personal liberty and their abiding faith in government. Contempt or misunderstanding of the principles of personal liberty and faith in government by no means make blacks unique among Americans, but the unique history of black Americans should make us, above all other Americans, most suspicious of any encroachment on personal liberty and most distrustful of government. Let's look at it.

The most serious injustices suffered by blacks came at the hands of government, at different levels, failure to protect personal liberty. Slavery was only the most egregious example of that failure. Congress and the courts supported the injustice of slavery through the 1850 Fugitive Slave Act and the Dred Scott decision. After emancipation, there were government-enforced Jim Crow laws denying blacks basic liberties and court decisions such as Plessy v. Ferguson that reinforced and gave sanction to private acts that abridged black people's liberties.



The heroic civil rights movement, culminating with the 1964 Civil Rights Act, put an end to the grossest abuses of personal liberties, but government evolved into a subtler enemy. Visit any major city and one would find that the overwhelmingly law-abiding members of the black community are living in constant fear of robbery, assault and murder. In fact, 52 percent of U.S. homicides are committed by blacks, 49 percent of homicide victims are black and 93 percent of them were murdered by fellow blacks. The level of crime in black communities is the result of government's failure to perform its most basic function, namely the protection of its citizens. The level of criminal activity not only puts residents in physical jeopardy but represents a heavy tax on people least able to bear it. That tax is paid in the forms of higher prices for goods and services and fewer shopping opportunities because supermarkets and other large retailers are reluctant to bear the costs of doing business in high-crime areas. This government failure has the full effect of a law prohibiting economic development in many black communities.

Then there's the grossly fraudulent education delivered by the government schools that serve most black communities. The average black high school senior has a sixth- or seventh-grade achievement level and most of those who manage to graduate have what's no less than a fraudulent diploma, one that certifies a 12th-grade level of achievement when in fact the youngster might not have half that. If the Grand Dragon of the Ku Klux Klan wanted to sabotage black academic excellence, he could not find a more effective means to do so than the government school system in most cities.

Tragically, most Americans, including black people whose ancestors have suffered from gross injustices of slavery, think it quite proper for government to forcibly use one person to serve the purposes of another. That's precisely what income redistribution is: the practice of forcibly taking the fruits of one person's labor for the benefit of another. That's also what theft is and the practice differs from slavery only in degree but not kind.

What about blacks who cherish liberty and limited government and joined in the tea party movement, or blacks who are members of organizations such as the Lincoln Institute, Frederick Douglass Foundation and Project 21? They've been maligned as Oreos, Uncle Toms and traitors to their race. To make such a charge borders on stupidity, possibly racism. After all, when President Reagan disagreed with Tip O'Neill, did either charge the other with being a traitor to his race? Then why is it deemed traitorous when one black disagrees with another, unless you think that all blacks must think alike?

I hope it's misunderstanding, rather than contempt, that explains black hostility toward the principles of liberty.

These Were the Ones that were Caught.

Okay they caught these ones, what about those that are not caught? This is just one of the many reasons why New Hampshire needs a homeschooling freedom law. Parents should not have to endanger their children by being forced to send their children to public schools where people like this exist.

The state has revoked credentials from 44 educators since 2000 for reasons including sexually assaulting children, possessing child pornography and stealing student funds, according to state records.

On average, 138 cases of alleged misconduct in schools are investigated each year, said Judith Fillion, director of the division of program support in the state Department of Education.

In an average year, about five state credentials -- required for teaching in New Hampshire -- are pulled, some immediately after teachers voluntarily surrender them rather than face revocation hearings.

Teacher behavior has been in the news recently, with at least four high-profile cases of alleged teacher misdeeds in Manchester, Merrimack and Londonderry involving drugs, alcohol or nude pictures e-mailed to a student.

Fillion said about 70 percent of the misconduct allegations are resolved at the local level, with the remainder probed by a state education investigator.

"There's quite a range, from something that can be handled easily that might be something like a misunderstanding and some, even though the local investigation does identify issues, we determine it doesn't rise to the level where we would revoke or suspend the credential," Fillion said.

Superintendents are required to report all allegations of misconduct to state education officials, Fillion said.

"There's been times we've (first) seen it in the newspaper, but most times superintendents are very good at reporting misconduct," she said.

The revocation list of educators includes teachers, guidance counselors and principals.


"Most revocations are due to inappropriate sexual conduct or improper use of technology," Fillion said in an e-mail.
Increasing vigilance

Since 1981, 100 educators, mostly teachers, have had their right to teach in New Hampshire taken away.

The list cites 36 revocations for alleged inappropriate and/or illegal sexual acts. Another 15 state a "lack of good moral character," phrasing allowed until education department rules pushed for more specific disclosures.

Fillion said the names of those whose credentials are revoked are entered into a national database to inform school districts in other states.

"When we get an application from another state, that's the first thing we look at," she said.

Last school year, New Hampshire had nearly 22,000 workers in public and private schools holding education credentials, Fillion said.

Mark Joyce, executive director of the New Hampshire School Administrators Association, said very few credentials are revoked each year compared to the large number of educators.

"One is too many, but it's still a pretty low incidence and (education) as a profession is becoming ever more vigilant with that," Joyce said.

Rhonda Wesolowski, president of the National Education Association-New Hampshire, said the safety and well-being of students "is of paramount importance" in schools.

"We believe that the misconduct of a relative few should not detract from the efforts of so many others of the nearly 20,000 teachers that do the right things every day," she said in an e-mail.
Range of cases

In the most recent case on the list, last updated Dec. 29, Christopher J. Cieto surrendered his teaching credential on Dec. 11.

Cieto, an English teacher at Hollis/Brookline High School, pleaded guilty to stalking for sending sexually explicit e-mails and instant messages to the mother of one of his students last year, according to Hollis police Sgt. Richard Mello.

"Whatever his potential as a teacher, he made some mistakes, some grave mistakes," Mello said last week.

Cieto was placed on probation for a year and will avoid jail if he exhibits good behavior for two years, Mello said.

One of the list's oldest cases involved Timothy A. Froncek, who taught at what was then Newfound Memorial High School in Bristol.

According to the revocation list, his credential was revoked on Jan. 12, 1982, for pleading guilty to second-degree murder. But Froncek didn't kill his wife until October 1983, and he didn't plead guilty to the murder until June 1984, according to a New Hampshire Union Leader story at the time.

According to another newspaper story, Froncek on Jan. 12, 1981, had his credential suspended for a year at the request of the Newfound Area School District. The district said Froncek gave only 24-hours notice for resigning his job, a breach of his contract.

Fillion said the credential wouldn't have been yanked until the second-degree murder plea was official. She planned to have
Froncek's entry amended.

Froncek received a 21-year prison sentence. Now 62, he has been out of prison since October 2001 and remains on lifetime parole, supervised out of the Nashua office, said state Corrections spokesman Jeff Lyons. Froncek couldn't be reached for comment.

Recent incidents
When a teacher voluntarily surrenders his credential, that teacher and the state education department enter a "negotiation" over the wording of why the credential was surrendered, Fillion said. A surrender automatically leads to a revocation, she said.

No teacher has asked for his education credential to be reinstated, but a few have inquired, Fillion said.

Recent cases of troubled teachers include two at Manchester's Hillside Middle School. The school board last Thursday fired Lynn Manning three weeks after police charged her with smuggling methadone pills into the state prison. Jennifer Boldwin resigned this month after wine was found in her classroom.

NJ teachers unions ratchet up the vitriol on Gov. Chris Christie

If a politician is making teachers unions mad, most likely he's doing something right. And Chris Christie has made teachers unions, very, very angry:

They're the kind of obscenity-laced schoolyard taunts that could get a student suspended.

But the target of this tirade is New Jersey's Gov. Chris Christie — and the perpetrators are the state's teachers, irate over his calls for salary freezes and funding cuts for schools.

In Facebook messages visible to the world — not to mention their students — the teachers have called Christie fat, compared him to a genocidal dictator and wished he was dead. The postings are often riddled with bad grammar and misspellings.

"Never trust a fat f...," read one profane post on the Facebook page, "New Jersey Teachers United Against Governor Chris Christie's Pay Freeze," which has some 69,000 fans, many of them teachers.

"How do you spell A-- hole? C-H-R-I-S C-H-R-I-S-T-I-E," read another.

But my favorite bit of criticism is this:




The acrimony intensified last month when Christie proposed cutting state and federal aid to districts by 11 percent, calling it a way to share sacrifice as the state tries to rein in spending.

That's when the Facebook attacks really took off.

One educator, a librarian with a Master's degree, described the cuts as "rediculous."

Yeah, why don't these people deserve higher pay! Good on the Associated Press for reporting this.

Reason Number 46 Why we Homeschool.

The teachers' unions make it nearly impossible to get rid of bad teachers and fear of lawsuits make it near impossible for previous employees to give bad references about former teachers. Every day I receive google alerts for the term teacher arrested. Parents need to have the right to freely homeschool and not be forced into a system where people like those below exist.

Naming Names: America’s Schools’ Problems Lie with Teachers’ Unions

In his 2007 book, Outrage, Dick Morris said it best: “There’s nothing wrong with America’s schools that breaking the power of the teachers unions wouldn’t cure.”

Few have had the courage to put it that directly. Our organization’s similarly blunt language puts a target on our back, but when you deal with organized labor, you know that comes with the territory. Expecting unions to act like professional organizations is like expecting the government to be frugal. It’s not in their DNA.

As Education Action Group Foundation chronicles daily on NEAexposed.com and AFTexposed.com, the national teachers unions and their state affiliates bully and punish school boards and administrators during contract negotiations and school elections. They work aggressively to elect union sympathizers to local school boards, then up end up negotiating friendly contracts with the candidates they just helped to elect. It’s a corrupt system that works to the detriment of children, parents and taxpayers.

And the teachers unions’ answer for school financial problems is always “more taxes,” rather than offering a few concessions that would save schools a ton of money.




When I was invited to speak to the Americans for Prosperity Tax Day rally at the state capitol in Lansing, Michigan last week, it was a first for me. I had never spoken at such an event. It was probably one of the few speeches around the country that zeroed in on the pirates of public education: the teachers unions.

The understanding that teachers unions are the problem, not the cure for our public schools, is finally starting to sink in with the public. Even President Obama, whose campaign collected millions from the teachers unions, has come out in favor of school reforms that the unions violently object to.

The time for change in our public schools is now, and it will start with curbing the power and influence of the teachers unions. Public schools belong to the people, and we’re in the process of taking them back.

Woman arrested is teacher

MERRIMACK – The woman arrested last week for allegedly having someone sober start her car is a teacher at Merrimack’s Mastricola Upper Elementary School.

Lisa Dinucci, 46, of 135A Baboosic Lake Road, Merrimack, was arrested April 3 and charged with alcohol ignition interlock circumvention, police said.

Dinucci, a French teacher at the elementary school, was required to install an ignition locking device on her car as a result of a Dec. 12, 2008, aggravated driving while intoxicated conviction in Milford District Court, police said. The device essentially requires a breath test to check alcohol content, before the car can be started.



Police allege that Dinucci convinced another person to blow into the tube for her on two occasions so that Dinucci could drive the car.

Marge Chiafery, superintendent of the Merrimack School District, said she found out about the arrest from a Telegraph story and placed Dinucci on paid leave while she conducts her own investigation.

Chiafery didn’t know how long Dinucci had been at the school but said she works on a continuing contract, so she’s been there at least four years. Dinucci teaches French to the school’s fifth- and sixth-grade students.

Chiafery said she had not heard any complaints or concerns from parents. She declined to explain what her investigation into the allegations would entail. She said putting a teacher on paid leave is a standard response in similar situations.

“I think obviously it’s just incumbent on me to do the investigation,” Chiafery said. “I’m always concerned about student welfare. We just need to find out the truth.”

Police didn’t report whether they were able to identify the person who allegedly blew into the device for Dinucci or whether that person might also be charged.

Dinucci was arrested Saturday, charged with alcohol ignition interlock circumvention, and later released on personal recognizance pending arraignment Tuesday in Merrimack District Court.

Debating Failing Schools

Are teachers unions to blame for failing schools?
This was the question debated last week on NPR's Intelligence Squared. At the beginning of the debate, less than half the audience believed teachers unions should be faulted for poor-performing schools, but by the close of the program, an astonishing 68 percent believed school employee unions contributed to the problem.

In Michigan, with the drama surrounding the federal Race to the Top competitive grant program, the role of teachers unions has been scrutinized. The Michigan Education Association refused to sign on to the reforms passed by the Legislature early this year, and many believe this was one of the reasons why the state wasn't selected to be one of the finalists for the first round of grant money.

The Intelligence Squared debate featured six panelists, three critical and three supportive of unions. The debate became heated at times, especially when the audience began asking questions. One pro-union participant, Randi Weingarten, president of the American Federation of Teachers, insinuated that the audience was packed by groups presupposed to be anti-union.

The effect of healthcare reform on home schooling

A national home school group is concerned that passage of the healthcare reform bill could pose a serious threat to parental rights and home school freedom.



According to the Home School Legal Defense Association (HSLDA), the pending healthcare legislation would provide federal grants to fund state home visitation programs. Attorney Will Estrada with HSLDA reports that states receive grants through a competitive system where preferences are given to states that have increased the number of families who are receiving services.

"So there could be some pressure on the states, because they want to receive this federal money, to look for families who are receiving these services, and then try to pressure them to get these services," Estrada warns.

He notes that the program in the bill is voluntary, but a foundation being laid reveals that the government thinks it knows how best to raise children.

"Once you start down that road, the next step could be, 'Oh, you don't want to take these federally funded services? Why is that? Is there any abuse going on? Should we be investigating your family?' And what could start out as a fairly good program for some families could basically become, 'If you don't receive these services, you're considered at risk' -- and you sort of go under the microscope," the attorney explains.

The HSLDA believes the federal government has no constitutional authority to fund and oversee home visitation programs and parenting classes.

New Hampshire teacher Melinda Dennehy arrested for sending nude photos to her student (photo)

Melinda Dennehy is the 41 year old Londonberry, New Hampshire teacher accused of "sexting" with one of her students. According to reports Dennehy sent a nude photograph of herself to a 15 year old student. That student then forwarded that photo to his friends.

Staff of the school became alarmed when the rumors of the photograph began to circulate throughout the school. The school then began it's own investigation of the incident placing Dennehy on paid leave.



According to CBS News Dennehy was charged with one count of indecent exposure and released on $10,000 bond under the condition that she keep her distance from children ages 10 to 17 years of age.

Dennehy will face arraignment on April 30, 2010.

Rouge Homeschoolers Blocking Freedom for All

Over the past twenty years several people have hindered homeschooling freedom in New Hampshire. I am not sure if it is because of arrogance, ignorance or their own little power trips.

Chris Hamilton and Mary Faiella are actively working against homeschooling freedom and are not supporting HB 1580 which would give homeschoolers the freedoms that is enjoyed by homeschoolers in 24 states across the United States.

If you are moving to New Hampshire there is a chance you will lose the freedoms which you experience in other states.

Chris Hamilton is a member of the HEC and appears to be more interested in aiding the HEC and the DOE in blocking homeschooling freedom than pursuing homeschooling freedom. Mary Faiella is a part of Chenh.org this group has not come out in full support of HB 1580. Chenh has posted to ask members to support HB 1580 but at this point I am unaware of them sending out notices to encourage its members to attend meetings and support passage of 1580.

The HSLDA is also not putting their full support behind this Bill.

Rep. Kim Shaw voted to ITL our bill during the final executive session over last minute concerns that DCYF would be the agency investigating any problems under the HB 1580 proposal. DCYF is not a problem in any of the other 24 states which allow complete homeschooling freedom, why should it be a problem in NH? It would seem that Rep. Shaw had been listening to the same misinformation that Chris Hamilton has been promoting.

And during the sub-committee session, as you may recall, Rep. Shaw had been listening to the same misinformation that Mary Faiella was promoting that the "purpose statement" of RSA 193-A was essentially the same as the Constitutional language in HB 1580.



This reminds me of how strongly I felt back in 1990 that it's a complete misnomer to classify those supporting state oversight of home instruction under RSA 193-A and those fighting for the liberty "to determine and direct the education of their children" as being similar in any way. We are most certainly not the same, and the NHHC and its representatives on the HEAC most certainly DO NOT REPRESENT the interests of liberty. For once again, the interests of liberty are being undermined nominally from within our own ranks.

Our bill, HB 1580 doesn't eliminate RSA 193-A, the home education law. So anyone worried about accountability could continue under the existing law.

But more importantly, home education is completely non-regulated in 24 states (see the list below). By population, that's more than half the home schoolers in this country have no oversight or regulation on their home programs. They haven't had any problems in these states. If they did, we would have heard because home schoolers are now interconnected via the internet. There are state groups and national groups that discuss these legal issues. Information exchange between states is very rapid.

The reason why there is no problem is because the initiation of any investigation for abuse or neglect requires probable cause to believe that a parent is neglecting or abusing their child.

The state needs probable cause to initiate an investigation to determine if there's sufficient evidence to prosecute the parent. After obtaining this information, the state must prosecute the parent in accordance with all Constitutional provisions for due process and a fair trial, during which the parent is considered innocent until proven guilty.

Some parents in other states maintain portfolios or obtain test results on evaluations as a precaution. If needed, this evidence will disprove any spurious allegations of educational neglect. But the parent need not submit this information until or unless charges are actually filed. Clearly, it would be very difficult for the state to prosecute random home schooling parents without cause.

Parents have these same "due process" rights under DCYF proceedings, unlike the current home education law where parents have no "due process" and are presumed guilty, required to submit evidence against themselves, etc. This is the problem: the total lack of "due process" under RSA 193-A despite the superficial inclusion of "grievance conferences," etc. That's too little too late, well after the parent's "due process" rights are trampled.

No person, including children, may be searched or seized without probable cause. All persons have the right not to incriminate themselves. All laws adopted to regulate education must be consistent and respectful of the equal protection provisions of the Constitution. The purpose of "due process" is to hold the government subservient to the law of the land, protecting individual persons from the state.

I'm very sorry to hear that you received this misinformation. I hope I've explained it clearly enough as it can be confusing even to myself on occasion. If there are any other concerns that would cause you to be unable to support HB 1580, please let me know.

There have been 15 bills brought before this legislature over last 20 years to either increase or decrease regulations on home schooling families. 15 bills in 20 years! Clearly, this issue is not settled in the hearts and minds of very many people.

Answering the attack on teachers

It's open season on the teachers' unions--and President Barack Obama has joined the hunt.

"If a school continues to fail its students year after year after year, if it doesn't show signs of improvement, then there's got to be a sense of accountability," Obama said in praise of the recent decision to fire all teachers at Central Falls High School in Rhode Island.

But while Obama's open endorsement of an effort to bust a teachers' union may seem shocking, his administration has been hammering teachers since he took office. Obama's $4.3 billion Race to the Top (RTTP) initiative doles out grants to states that have laws attacking teacher seniority rights and that tie teachers' pay to student test scores.



With the recession drying up normal funding channels for schools, states are rushing to pass union-bashing laws to get a shot at the federal money--even as they impose layoffs and cutbacks to close huge budget deficits.

The two big teachers' unions--the American Federation of Teachers (AFT) and the National Education Association (NEA)--have so far failed to mount resistance to these attacks. But in teachers' union locals across the U.S., rank-and-file activists and union reformers have been trying to organize a fightback. In California, grassroots pressure led both the California Federation of Teachers and California Teachers Association to back the March 4 Day of Action to defend public education in that state.

Here, teachers across the U.S. talk about the battles they face and their efforts to resist the onslaught on their unions. Participants in the roundtable are Megan Behrent and Brian Jones from the United Federation of Teachers (UFT) in New York City; Laura Taylor from the Houston Federation of Teachers (HFT); Gillian Russom of United Teachers Los Angeles (UTLA); Adrienne Johnstone of United Educators of San Francisco (UESF); and Nate Goldbaum from the Chicago Teachers Union (CTU).

Please Support HB 1580

I sent the following letter to Representative Casey asking for Support for HB 1580. She did not respond and she did not support HB 1580.

Dear Honorable Representative Casey,

The need for passage of HB 1580 with number 9 intact is not only an inalienable right but a civil right that must be upheld for homeschooling families. It is a right that must be guaranteed just as is the right to vote for women and the right to bear arms. Twenty-five states across the country do not interfere with parents' rights to educate their children as they see fit. New Hampshire already has some of the strictest laws in the nation.

Study after study shows that homeschoolers outperform their private and public schools peers. Some universities and colleges actively seek out homeschoolers because of their excellent base of knowledge and skills. But I am sure you are well aware of this because I am absolutely positive you have researched this area.


In 2008 Education Commissioner Lyonel Tracy stated: "We need to dig deep and find out what's happening here," when talking about the poor test scores of our 11th grade public school educated students. 45% of these students tested "substantially below proficient." This was on the math portion of the NECAP tests.

AYP reports from the NH Dept of ED in 2008 showed that 62% of public schools failed to make adequate yearly progress and 40% of schools are in need of improvement.

According to the 2009 NECAP test results, 31%, 20%, and 78% of 11th grade Newport students scored in the "proficient" level in writing, mathematics, and reading respectively. Do the math and you will see the numbers of those failing. My children deserve better than to be graded by our school system that is failing to educate its own students.


Yes Representative Casey tens of thousands students are falling through the cracks and this is why many of us homeschool. Do you want to help children falling through the cracks? Work on legislation to improve public schools. I pay for them I would like to use them but I do not want to send my children into a system where 62% of public schools fail to meet adequately yearly progress. As a parent, why would I send my child to a school when they have more of a chance at failure than they do success?

I see plenty of evidence of failures in public schools but I do not see any evidence of failure among homeschoolers in New Hampshire. Show me the evidence and the cases where homeschoolers are falling through the cracks. To remove section 9 of HB 1580 and deny homeschooling parents their rights to educate their children as the see fit is unconscionable. Why should my child be denied her right to the best education possible, education provided in my home?

Why enact laws to catch 5 or 10 homeschoolers falling through the cracks when you have thousands of students failing through the cracks in public schools? If you are concerned about child safety the police will catch those people. No one law will allow no one person to fall through the cracks.

Perhaps you think that falling through the cracks is the possible abuse in homes. Show me the research and the history of that because I can show you plenty of sexual misconduct occurring every day in public schools.

Below my letter I have listed the teachers convicted of sex crimes in New Hampshire I have listed the teachers arrested in the past week for sexual misconduct or misconduct of one form or another.

I want a choice to educate my child in a system that is not failing, in a place where she is not exposed to possible sexual misconduct and a place where she does not encounter crime. How can you look at this and deny me my family our right to protect our children the best we can.

Please focus your energies on correcting the problems in our public schools, the continued attacks in light of these failures looks like some legislators have a vendetta against a minority group and that group is homeschoolers.





Please do not take away our inalienable rights, our civil rights and support HB 1580 as introduced.

Jennifer Simard, 24, an on-call substitute teacher’s aide in the Goffstown School District, in Goffstown, New Hampshire has been indicted by a Hillsborough County grand jury, arrested and jailed on two counts of prohibited use of computer services.

It is alleged that Simard had sexually explicit online conversations with a boy who is younger than 16-years-old during the months of August and September. The grand jury indictment also alleges that Simard discussed with the boy how he could keep his parents from finding out about them.

Reportedly Hillsborough County Attorney Marguerite Wageling yesterday dropped four similar counts filed against Simard after researching state law.

A school spokesperson said Simard had been told before the academic year started that her services were no longer needed and she was not allowed on school property.

A former Spaulding High School teacher accused of sexually assaulting a student more than 20 years pleaded guilty Friday to a sexual assault charge shortly before his trial was scheduled to begin. Greg Ingalls, 57, of 4 Park Lane, a former Spaulding math teacher and longtime Barrington School Board member, was charged in April 2007 on a Class B felony of sexually assaulting a teenager in property he owned in Raymond in the mid-1980s.

On Friday, Rockingham County Superior Court Judge John Lewis sentenced Ingalls to 12 months in the Rockingham County House of Corrections to begin immediately, according to a clerk court. Police have said the assault occurred between 1984 and 1985 when Ingalls drove a 14-year-old Rochester boy — a Spaulding High School student — to his Raymond apartment, located in a Main Street building. In May Ingalls resigned in from his post on the Barrington School Board and in late June the Rochester School Board accepted his retirement resignation.

A former high school teacher accused of raping a student in Hudson is claiming in court papers that he was involved in a “romantic” sexual relationship with the 16-year-old girl.

Kevin Goddu, 45, of Chelmsford, Mass., is facing 14 counts of felonious aggravated sexual assault for allegedly raping a former student at a home on Sullivan Road in Hudson earlier this year.

According to court records, Goddu, then a teacher at Timberlane Regional High School, allegedly pinned the 16-year-old Plaistow girl down on a bed and raped her the afternoon of Feb. 27.

But Goddu’s attorney, in court papers filed in Nashua Superior Court, claims the girl consented to sex with his client, and “several witnesses” are prepared to testify that their relationship was “romantic.”

A former Lowell (Mass.) High School math teacher and chess coach was sentenced Monday to 20-40 years in prison for repeatedly raping a young girl.

Speaking before he was sentenced, Severine Wamala, 46, formerly of 6 Danforth Road, Apt. 22, attacked the girl one last time, saying she had always been a difficult child and was prone to lying. He also said he loves and forgives her.

Judge Robert Lynn has prohibited Wamala from having any further contact with the girl as a condition of his sentence. Wamala had been jailed since his arrest last year and was convicted after a trial in September in Hillsborough County Superior Court. He plans to appeal his conviction on 11 counts of aggravated felonious sexual assault, his lawyer, public defender Anthony Sculimbrene said.

Prosecutors had charged Wamala with raping two other young women as well, but those charges were dismissed after both women recanted, and testified police had pressured them into making false allegations against him.

A former Kingston elementary school music teacher was sent to prison yesterday after admitting to molesting a boy for three years during the 1980s.

Kenneth Lang, 60, of Amesbury, Mass., and Newton, N.H., will spend the next 7 1/2 to 15 years in state prison for abusing the boy, now 36, who reported the abuse to police just last year. Lang pleaded guilty to eight felonies yesterday as part of a plea deal.

He is scheduled for trial in Essex County (Mass.) Superior Court late next month for a similar pattern of assaults — with the same victim — that occurred in Haverhill, Mass. Lang's victim said yesterday he finally disclosed the years of abuse in 2006 because he learned that Lang was teaching music at D.J. Bakie Elementary School in Kingston, where he worked for 13 years.

A former teacher serving time in New Hampshire for molesting one of his students now faces similar charges in Vermont.

39-year-old Kelly Johnston of Colebrook pleaded guilty Monday to sexually assaulting a 13-year-old girl in New Hampshire. He was sentenced to serve three years in jail.

Today Vermont State Police charged him with two counts of lewd and lascivious conduct on the same child. Police say Johnston molested the girl as he gave her rides home to Essex County from the Stratford Public School.
